Cannabis gifts in Brooklyn: what New York law allows

Can you give cannabis as a gift in New York?

Yes. Under New York Penal Law 222.05, an adult 21 or older can give another adult 21 or older up to 3 ounces of cannabis and up to 24 grams of concentrated cannabis, as long as nothing is paid or traded in return. A sealed, labeled package from a licensed dispensary shows the person exactly what they are getting.

Cannabis flower: Up to 3 ounces
Concentrated cannabis: Up to 24 grams
Payment or trade: None. A gift has nothing given in return

Can I take cannabis from New York on a flight or across state lines?

No. Cannabis bought in New York has to stay in New York. Carrying it across a state line or mailing it is illegal under federal law, even when the place it is going also has legal cannabis. If you are in Brooklyn for the holidays, plan around that.

Chapter III · The letter of the law

What does craft cannabis mean in New York?

In New York, craft is a legal term. State regulation 9 NYCRR 118.1(b)(31) defines a craft product as flower or pre-rolls that are hang-dried, processed and manufactured entirely by a licensed microbusiness, or by a Tier 1 cultivator using only plants it grew. Advertising may use the word only for products that qualify.

Who can make it: A licensed New York microbusiness of any type, or a Tier 1 cultivator processing only plants it grew
What it covers: Flower and pre-rolls, plus any product that meets the Office's craft designation
How it is dried: Hang-dried, the way a barn full of harvest is hung from the rafters
Where the rule lives: 9 NYCRR 118.1(b)(31) defines it; 9 NYCRR 129.2(b)(19) limits the word in advertising
How Hii applies it: Every card states its producer's license type. A Craft label is added only after a producer's Office of Cannabis Management craft designation is confirmed, not because a brand calls itself craft.

Hii NYC was founded in April 2024 by Peter Beznos, a 20-year cannabis advocate, as one of Brooklyn's first legal adult-use dispensaries under the New York Office of Cannabis Management's CAURD program. The flagship storefront sits at 152 Bedford Avenue in Williamsburg, a block from the L train, with a second location at 9206 3rd Avenue in Bay Ridge.
